ORDER

The petitioners are accused 1 to 3 in Crime No.564 of 2025 on the file of the 1st respondent police, which was registered for the offence under Section 308(5) of BNS 2023. They have filed this petition seeking to quash the proceedings pending against them, on the ground that the issue has been amicably settled among themselves.

2. The petitioners 1 and 2 are minors and they are brothers. The 3rd petitioner is the friend of the 2nd petitioner. The case of the prosecution is that the 1st petitioner herein is the classmate of the defacto complainant's son and he is the close friend of the defacto complainant's son. The 2nd petitioner is the elder brother of the 1st petitioner and all the three persons went to the garden of the petitioners and they introduced the habit of smoking and also took a videograph. After six months, the 2nd petitioner sent the picture of smoking to the defacto complainant's son and threatened him to bring the jewels and thereafter, received the jewels from him on 06.03.2025. Again, they received two rings from him on 09.05.2025 and also a sum of Rs.20,000/- on 31.05.2025. Based on the complaint given by the second respondent/defacto complainant, the case in Crime No.564 of 2025 has been registered by the respondent Police. 2/4

3. This Court has also perused the First Information Report.

4. Considering the nature of offence as projected in the FIR, this Court is not inclined to quash the FIR in Crime No.564 of 2024 on the ground of compromise.

5. Therefore, this Criminal Original Petition is dismissed. The respondent Police is directed to conduct the investigation in Crime No.546 of 2024 in a proper manner and find out as to whether the accused persons have involved in similar offence and to file the final report within a period of three months from the date of receipt of a copy of this order. 25.07.2025 NCC : Yes/No Index : Yes/No Internet:Yes ogy To
