PRAYER :- Criminal Original Petition filed under Section 482 Cr.P.C. transferring the process of investigation of case in Crime No.384/2020 from the file of the 4th respondent to the District Crime Branch, Tirunelveli District or any other agency as this court. ORDER

This Petition has been filed to transfer the investigation of case in Crime No.384/2020 from the file of the 4th respondent to the District Crime Branch, Tirunelveli District or any other agency.

2. The grievances of the petitioner is that the accused persons damaged the High Voltage Electric Poles erected on the land belongs to High Ways Department near Pillayarkulam junction at Manur on Tirunelveli Sankarankoil High Way. Hence, the petitioner given a complaint before the fourth respondent police and a case has been registered in Crime No.384 of 2020 for the offences under Sections 294(b), 427, 506(ii) of IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act. 1/3

3. The learned Government Advocate (Crl.side) would submit that the entire investigation has been completed in Crime No.384 of 2020 and final report yet to be filed before the concerned Court shortly.

4.Considering the nature of the offence, there shall be a direction to the fourth respondent police to file final report within a period of three weeks from the date of receipt of a copy of this order. It is made clear that if any grievances are available to attract the offence under Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, the fourth respondent is directed to file a final report including the offence under Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act. With the above direction, this Criminal Original Petition is disposed of.
