Civil Miscellaneous Petition fild under Order 9 Rule 9 of c.p.c.to set aside and restore the CRP (MD) No.628 of 2022 dismissed for non prosecution on 19.06.2023 and thus render justice.

Prayer in CRP(MD). No.628 of 2023:- Civil Revision Petition filed under Article 227 of the Constitution of India to struck off the petition in DVC No. 12 of 2022 on the file of Learned Judicial Magistrate, Pattukottai, Tanjore District and quash the proceedings in so for as the petitioners herein.

ORDER:- This Civil Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Ms. V. Balu, Advocate for the Petitioner , this Court made the following order:

Being satisfied with the reasons given in the affidavit filed for non-appearance on the side of the petitioners on 19.06.2023 when the above Civil Revision Petition was dismissed for non-prosecution, the order dated 19.06.2023 is set aside and the above Civil Revision Petition is restored to the file of this Court.
