ORDER

The Writ Petition is filed seeking for a Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 10.12.2020.

2. The allegation in the Writ Petition is that several false cases have been foisted against the petitioner at the instance of the fourth respondent. The petitioner had further stated that on 07.10.2020 at about 00.41 hours when he was at his residence, the fourth respondent along with some Constables trespassed into his house and abused him. Complaining about the act of the fourth respondent, the petitioner had given a representation to the respondents 1 to 3 on 10.12.2020. No action was taken by the respondents on the said representation and hence, this Writ Petition has been filed.

3. The learned Additional Public Prosecutor appearing for the respondents submitted that if the fourth respondent has committed an offence or has taken illegal action, it is for the petitioner to approach the competent Court and disputed facts cannot be gone into a Writ Petition. 2/5

4. Considering the prayer made in the Writ Petition, the third respondent shall consider the petitioner's representation dated 10.12.2020 after giving sufficient opportunity to the petitioner and the fourth respondent and take action in accordance with law. The third respondent shall take such action as expeditiously as possible and in any event, within a period of twelve (12) weeks from the date of receipt of a copy of this order. The third respondent shall not be influenced by any of the observations made in the order passed by this Court and shall independently consider the complaint on its own merits.

5. This Writ Petition is disposed of accordingly. There shall be no order as to costs.
