PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 1st respondent to send the report of enquiry dated 28-10-2020 conducted by her to the 2nd respondent on the Dowry harassment complaint (CSR.51/2020 pending before 2nd respondent) made by the petitioner. O R D E R
This writ petition has been filed for the issue of a writ of mandamus directing 1st respondent, namely, the District Social Welfare officer to submit a report of enquiry to the 2nd respondent in order to enable the second respondent to proceed further with the complaint that is pendng in CSR.51/2020.
2.When the matter was taken up for hearing, the learned Government Advocate appearing on behalf of the 2nd respondent submitted that the first respondent has already submitted a report dated 06.01.2021 to
the second respondent. The copy of the report was also placed before this Court.
3. The learned Special Government Pleader appearing on behalf of the first respondent, by placing reliance upon the counter affidavit filed by the first respondent submitted that the first respondent has already submitted the enquiry report to the second respondent. To substantiate the same, the learned Special Government Pleader placed reliance upon paragraph No.6 of the counter.
4. The learned counsel for the petitioner submitted that the petitioner had simultaneously initiated proceedings against the private respondents under the Domestic Violence Act before the Judicial Magistrate, Tenkasi and final orders were passed in favour of the petitioner on 18.05.2023. The learned counsel for the petitioner further submitted that the matter is now pending by way of appeal before the Principal District and Sessions Judge, Tirunelveli in Crl.A.No.90/2023.
5. In the light of the submission made by the learned Special Government Pleader and the learned Government Advocate and the counter affidavit filed by the first respondent, no further orders are required to be passed in the writ petition except taking into account the subsequent development that has taken place in this case. Accordingly, this writ petition is disposed of. No costs.
