ORDER : The Court made the following order :- The petitioner, who arrayed as accused, was arrested and remanded to judicial custody on 02.04.2024 for the offences punishable under section Girl missing @ 366 IPC, Section 5(i), 5(n) r/w. Section 6, 7 r/w. Section 8 of the POCSO Act, 2012 in Crime No.39 of 2024 on the file of the respondent police, seeks bail. 1/3

2.The case of the prosecution is that the petitioner herein has sexually assaulted the victim girl, who is aged about 17 years with the help of his paramour. Hence, the compliant.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he is in judicial custody from 02.04.2024 and seeks bail. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner herein is prime accused and the A2 is paramour and the charge sheet has been filed in this case and he strongly opposed to grant bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering serious nature of allegations made against the petitioner, this Court is not inclined to grant bail to the petitioner.
