the records relating to the proceedings of the 4th respondent in Na.Ka.A4/5291/2025 dated 15.10.2025 and 09.02.2026, quash the same as illegal, arbitrary and contrary to the original revenue records and consequently direct the respondents to rectify the UDR error relating to survey No.370/4A, Sangampatty Village, Kottaiyur Majra, Thuraiyur Taluk, Tiruchirappalli District, based on the revenue records.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) Challenging the notices issued under Sections 7 and 6 of the Tamilnadu Land Encroachment Act 1905, the present writ petition is filed.

2. The main contention of the learned counsel for the petitioner is that the explanation submitted by the petitioner has not been considered and in the original FMB relating to subject place, there is no mentioning of Nilaviyal Paathai which has not been taken note of by the authorities.

3. Be that as it may, we are of the view that the petitioner has effective appeal remedy under Section 10 of the Act before the 1st respondent/District Collector. Therefore, the petitioner is permitted to file appeal before the 1st respondent/District Collector within a period of two weeks from the date of 2/4

receipt of a copy of this order and canvass his case before the District Collector and produce all the records. The District Collector may peruse the records and pass orders on merits and in accordance with law. Till the abovesaid two weeks time limit, there shall not be any order of eviction.
