Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to issue passport to the petitioner by considering his application dated 29.05.2025 in Application Reference No.ARN 25-1052903495 in File No. MD 1065140048625.

ORDER
This Writ Petition has been filed for directing the first respondents to issue a passport to the petitioner by considering the petitioner's application, dated 29.05.2025.
2. The petitioner is one of the accused in First Information Report registered in Crime No.183 of 2024 for the offences punishable under Sections 49, 296(b), 115(2) and 118(1) of the Bharatiya Nyaya Sanhita (BNS), 2023.
3. It is informed by the learned counsel for the second respondent would submit that the Charge Sheet has been filed against the petitioner and the same has been taken on file by the learned Judicial Magistrate, Melur in C.C.No.213 of 2025.
4. Recording the submissions made by the learned counsel for the respondent that the criminal case is pending against the petitioner, there is no scope for any positive direction to be issued to the first respondent for issuing passport to the petitioner in view of the limitation under Section 6(2)(f) of the 2/4
Indian Passport Act, 1967. Therefore, this Writ Petition is liable to be dismissed. However, liberty is given to the petitioner to file an appropriate application before the said Court at appropriate time to facilitate the first respondent in processing the application for issuance of passport at a later point of time.
