ORDER

The petitioners are working as Teachers. They have approached this court challenging the orders of the Joint Director (Vocational) dated 26.12.2020 with consequential relief to refix the scale of pay of the petitioners as provided to one Narayanasami vide GO.Ms.No.327, dated 18.11.2013. 2/6

2.This court by its order dated 01.08.2024 directed the 3rd respondent to consider the claim of the petitioners and pass suitable orders on par with the scale of pay provided to one Narayanasami vide GO.Ms.No.327, dated 18.11.2013 within a stipulated time.

3.Now these contempt petitions have been filed that the order of this court has not been complied with.

4.When these petitions are taken up for hearing, the learned Additional Advocate General appearing for the respondents submits that the government order in GOMs.No.327 dated 18.11.2013 is not applicable to the petitioners and therefore, they have rejected the claim of the petitioners. A copy of the proceedings dated 11.07.2025 is also placed before this court. 5.The learned counsel for the petitioners by referring to the orders of the Division Bench in WA(MD)No.1344 of 2013 dated 14.08.2014 submits that the order passed by this court in WP(MD)No.5766 of 2020 has already been confirmed by the Division Bench of this court and even then the respondents have 3/6

rejected the request of the petitioners without even referring to the orders of the Division Bench.

6.This court has considered the rival submissions made and perused the materials placed on record.

7.The writ court has disposed of the writ petitions as under: "6. Since the petitioners are also similarly placed as that of the petitioner in W.P.(MD)No.5766 of 2008 and in view of the judgment in W.A.(MD)No.1344 of 2013 dated 14.08.2014, this writ petition is allowed and the impugned bearing Na.Ka.No. 36584/V1/E1/2020 issued by the third respondent in WP(MD)No. 18217 of 2024, dated 26.12.2020 is set aside. The respondents are directed to consider the claim of the petitioners and pass suitable orders on par with the scale of pay granted to G.Narayanasami as per G.O.Ms.No.327, dated 18.11.2013 within a period of four weeks from the date of receipt of a copy of this order. No cost."

8.The respondents have now passed an order vide proceedings dated 11.07.2025 that the petitioners are not entitled for the relief as per GO.Ms.No.327 dated 18.11.2013. Considering the scope of the orders passed in the writ petitions, these contempt petitions are closed with liberty to the petitioners to challenge the rejection order in the manner known to law.
