ORDER

The Writ Petition is filed seeking a direction to the respondents to survey the land in S.No.451/2 and 451/3 situated at Malvarpatty Village, Vedasandur Taluk, Dindigul District by considering the petitioner's representation, dated 01.07.2025.

2. Heard the arguments of Mr.T.Manikandan, learned counsel for the petitioner and Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4. According to the petitioner, the subject property was purchased by him under two sale deeds, dated 28.04.2025 from one Sundari and two others. Patta for the subject property stands in the name of the petitioner in patta No.3409. When the petitioner attempted to file application for survey of the property through on-line, his application was not accepted by on-line

portal on the ground that the petitioner's vendor already submitted an application for survey of the property. Therefore, the petitioner submitted instant representation before the respondents on 01.07.2025, seeking survey of the subject property. The same has not been considered. Hence, the petitioner has come before this Court.

The learned Government Advocate, who takes notice for the respondents would submit that the first respondent will issue notice to the vendor of the petitioner and take a decision on the application submitted by them within three weeks from the date of receipt of copy of this order. Thereafter, the petitioner is entitled to file fresh application seeking survey of the property.

6. The said submission made by the learned Government Advocate is recorded. The first respondent is directed to dispose of the application already filed by the vendor of the petitioner within a period of three weeks from the date of receipt of copy of this order. Thereafter, the petitioner, if so advised, may file fresh application seeking survey of the subject property. On submission of fresh application, the first respondent shall consider the

same and pass final orders on its own merits within a further period of eight weeks, after affording reasonable opportunity to the petitioner, neighboring land owners and other interested parties.

7. With the above direction, this Writ Petition stands disposed of. No costs.
