O R D E R

The petitioner herein seeks a direction to the first respondent to cancel the patta issued in favour of the respondents 2 and 4 in respect of the lands situated in Survey Nos.99/7, 103/2, 104/9 and 90/9 in Merpanaikadu Village and Survey Nos.19/2, 19/5, 22/4 and 37/5 in Sathanenthal Village, Aranthangi Taluk, Pudukottai District, by considering her representation dated 04.04.2025. 2.Heard the arguments of Mr.N.Jeyaram Sidharth, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the first respondent. Since no adverse order is passed against the respondents 2 to 4, notice to them is dispensed with.

3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.According to the petitioner, the subject property originally 2/6

belonged to her maternal grandmother, Pathumuthuammal. She gifted some of the property in favour of the petitioner under oral hiba and executed the document on 01.03.1982. She died in the year 1997. After death of Pathumuthuammal, the patta for the subject property has been issued in favour of the respondents 2 to 4 and some other third parties, excluding the petitioner and the legal heirs of Pathumuthuammal. Therefore, the petitioner submitted a representation before the respondent on 04.04.2025 seeking cancellation of the patta issued in the names of private respondents. The same has not been considered till date. Hence, the petitioner has come before this Court. 5.The learned Additional Government Pleader appearing for the first respondent would submit that the petitioner has not submitted the representation before the competent authority, namely, the Revenue Divisional Officer, Aranthangi and hence, his representation has not been considered.

6.In view of the submission made by the learned Additional Government Pleader appearing for the first respondent, without expressing any opinion on the merits of the claim made by the petitioner, 3/6

the first respondent is directed to forward the representation of the petitioner dated 04.04.2025 to the Revenue Divisional Officer, Aranthangi, Pudukottai District, within a period of two weeks from the date of receipt of a copy of this order. The said authority shall consider the representation of the petitioner and pass final orders on its own merits, within a period of 12 weeks thereafter, after issuing notice to the petitioner, private respondents 2 to 5 and other parties in whose names the patta has been issued. Accordingly, this Writ Petition is disposed of. No costs.
