By relying on sale deed dated 26.08.2016 and the adangal extract in respect of Survey No.278/25, the petitioner had applied for patta. The said request was rejected by impugned order dated 05.06.2023.
2. Learned counsel for the petitioner submits that the impugned order states that there is a discrepancy between the survey number and the document submitted by the petitioner. Without providing any further reasons, he submits that the petitioner's request for patta was rejected.
3. Learned Government Advocate appears on behalf of the respondents. He submits that the impugned order refers to the surveyor's report dated 12.05.2023.
4. In the impugned order, it is stated that the document submitted by the petitioner and survey numbers are different. No other reason is specified in the impugned order. On perusal of the sale deed in favour of the petitioner, it appears that the natham survey number is mentioned therein as 136/81. On perusal of the adangal extract, it appears that the old survey number was 136/81 and the new survey number is 278/25. 2/4
Prima facie, it appears that there is no discrepancy. Therefore, the matter requires reconsideration.
5. For reasons set out above, the impugned order dated 05.06.2023 is set aside and the matter is remanded to the Tahsildar for reconsideration. After providing a reasonable opportunity to the petitioner a fresh order shall be issued within three months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
