O R D E R
The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the first respondent to survey and demarcate the land comprised in Survey Nos.456/2A and 456/3A, situated at Sithuvarpatti Village, subdivide the same and issue a separate patta in the name of the petitioner.
2. The petitioner claims rights over the property in Survey Nos. 456/2A and 456/3A situated at Sithuvarpatti Village as ancestral property. In respect of the said property in Survey No. 456/2A, a Joint Patta bearing Patta No.738 was issued in the names of Sadaiyan Chettiyar, Subramanian Chettiyar, Arumugam, Kuppusamy Chettiar and Murugesan Chettiar. The petitioner claims that his name has been shown as "Murugesan Chettiar".
3. There are four other joint pattadars. Therefore, the first respondent shall first issue notice to all the joint pattadars and thereafter shall consider the petitioner's claim for a separate patta by surveying and demarcating the land. In case the said property could be divided among the joint pattadars, the first respondent shall conduct a survey with the assistance of the second respondent after issuing notice to the petitioner, Page No. 2 of 5
the other joint pattadars and any other rival claimants/objectors, if any, in accordance with law and thereafter subdivide the property. In case the said property could not be divided, the parties may be directed to approach the competent Civil Court, in accordance with law.
4. While surveying the land, the respondents shall adhere to the following Standard Operating Procedures:
• The respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.
• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.
The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
