THE HONOURABLE DR.JUSTICE D.NAGARJUN Saravana Theva ... Petitioner /vs./ 1.The Superintendent of Police, Pudukkottai District, Pudukkottai.

... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to grant permission for conducting Road Roke and Public Meeting scheduled to be held 20.07.2023 at Mankottai Vilakku, Karambakudi Taluk, Pudukkottai District, on the basis of the petitioner's representation dated 05.07.2023. ORDER

This petition is filed seeking for a direction to the respondent police to grant permission for conducting Road Roko and Public Meeting scheduled to be held 20.07.2023 at Mankottai Vilakku, Karambakudi Taluk, Pudukkottai District, on the basis of the petitioner's representation dated 05.07.2023. 2.It is surprising to know that even after repeated directions not to cause disturbance to the normal life of the people and free flow of the traffic in a public road, the petitioner has filed this petition seeking direction to the police to permit them to stage road roko. If the petitioner has got any grievance on any issues either with the Government Officials or with the private party, they are expected to approach various institutions to resolve their grievances and if the institution fails to respond properly, then they can approach appropriate Court for a suitable direction.

3.It is submitted by the learned Government Advocate (Crl.side) that the petitioner has gone to the office of the Revenue Divisional Officer and threatened him asking to cancel the patta, which was allegedly given in favour of a third 2/5

person incorrectly. In case if the petitioner has got any grievance in respect of issuance of patta to the private person, the proper way is to approach the Revenue Tribunal and get the said patta to be cancelled. The petitioner is not expected to take the law into his hands and high-handedly cannot threaten the Government Officials. In fact a criminal case should have been filed against the petitioner, in case if really the petitioner has threatened the Revenue Divisional Officer. At this stage, the learned counsel for the petitioner requested this Court to withdraw this petition, so that he can approach the appropriate forum. 4.Request of the learned counsel for the petitioner is considered and accordingly, this Petition is dismissed as withdrawn by permitting the petitioner to approach the appropriate forum questioning the illegal grant of patta in favour of a third party. No costs.
