PRAYER :-For Bail in Crime No.67 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 02.08.2022 for the offences punishable under Section 379 IPC and Section 21 (1) of MMDR Act in Crime No.67 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner has transported 24 tons of Gundukal worth about Rs.8,400/- without any valid permission by using Taras Tipper Lorry. Therefore, the present case came to be registered.
3.The learned Government Advocate (Crl. Side) for the respondent police submitted that the petitioner is having no previous case.
4.Considering the facts and circumstances of this case that no previous bad antecedents is reported against the petitioner and considering the duration of custody, this Court is inclined to grant bail to the petitioner with certain conditions. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.15160 of 2022 5.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nanguneri, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
