It is submitted by the learned counsel appearing for the petitioner that there were disputes between the petitioner and the accused persons, on account of which, the accused persons brutally attacked the petitioner. Therefore, the petitioner has given a complaint before the respondent Police, basing on which, a case in Crime No.69 of 2023 was registered for the offence punishable under Sections 342, 294(b), 324 and 506(2) of IPC. It is submitted that there is no substantial progress in the investigation.

The learned Government Advocate (criminal side) appearing for the respondent Police, on the other hand, submits that soon after registration of the case, the investigation was taken up and completed and a final report was filed as mistake of fact. On 18.03.2023, RCS notice was also served on the petitioner, who is the defacto complainant.

4. Once the investigation has already been completed and RCS notice is stated to have been served on the petitioner, no further order can be passed in this petition.

5. Accordingly, this Criminal Original Petition is dismissed as infructuous. However, the petitioner is at liberty to challenge the final report if he is so advised.
