Respondent / Respondent / Complainant Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extend the time by 4 weeks in order to enable me to comply with the order passed by this Honble Court in Crl MP(MD) No.3951 of 2023 in Crl RC(MD) No.275/2023 dated 12.06.2023 on the file of this Honble Court.
Prayer in CRL RC(MD) No.275 of 2023:
To call for the records and set aside the impugned judgment dated 20.12.2022 made in C.A.No.53 of 2022 on the file of the learned 3rd Additional District and Sessions Judge, Tiruchirappalli confirming the judgment and conviction in STC No.9 of 2017 passed by the learned Judicial Magistrae No.4, Tiruchirappalli dated 04.04.2022 and allow the above revision petition. Order : This criminal miscellaneou petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.JAMEELARASU.B, Advocate for the petitioner, the court made the following order:- This petition has been filed to extend further 4 weeks of time to comply with 1/3
the conditional order passed by this Court in Crl.MP(MD)No.3951 of 2023 in Crl.RC.275 of 2023 dated 12.06.2023.
2. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that due to financial criteria, he could not comply with the order of this Court. Hence, he seeks further time. 3.It is seen that on the undertaking given by the petitioner to deposit 50% compensation amount, the said conditional order was passed on 12.06.2023. Even though number of opportunities were given to the petitioner, he has not complied with the condition. This Court does not find any merit in this petition. 4.Accordingly, this petition is dismissed.
