ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to extend the lease period for one year for running quarry in the petitioner's land in Survey No.32/1B Ervadi Village, Keelakarai Taluk, Ramanathapuram District, which was already granted by the 3rd respondent by his order in Na.Ka.No.231/G&M/2023, dated 21.06.2024, for the period of 25.06.2024 to 24.06.2025 by considering the petitioner's representation, dated 21.03.2025.

2.The facts are that the petitioner was already granted permission through Na.Ka.No.231/G&M/2023, dated 21.06.2024, for the period of 25.06.2024 to 24.06.2025. The petitioner has quarried only 7200 cubic meters. The petitioner entitled to 18,600 cubic meters, as per the permission. While the petitioner was carrying on the quarry, certain objections were raised by third parties. Based on the third party objections, the respondents restrained the petitioner from further quarrying. As per the original permission, the petitioner is further entitled to quarry for the balance 11,400 cubic meters but he is not able to carry out at the balance 11,400 cubic meters. Subsequently, the said third party objection was considered and it was held to be false. Now, the period has lapsed and the petitioner could not do the balance quarry due to the false allegations. Hence, the petitioner is seeking to extend time of lease. 2/5

3.Mr.K.Vijaya Ragavan, Deputy Director of Department of Geology and Mining, Ramanthapuram, is present before this Court. On instructions from Mr.K.Vijaya Ragavan, the learned Special Government Pleader appearing for the respondents submitted that for the non operating period, they would consider and pass orders. However, the same would be considered if the petitioner submits relevant documents, especially, environmental clearance from the appropriate authorities and they would also do field inspection to ascertain the present status of the quarry land.

4.Therefore, the respondents are directed to consider the petitioner's representation, dated 21.03.2025. The petitioner shall submit the additional documents especially, environmental clearance and other documents to the respondents within a period of four weeks from the date of receipt of a copy of this order. On receipt of the documents, the respondents shall consider to extend the lease period for the non-quarrying period within a period of four weeks therefrom.

5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
