ORDER
Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for the respondents 1 and 2. Private respondents have been served and their name is printed in the cause list, they have not chosen to enter appearance. 2.The writ petitioner had purchased the petition mentioned property vide sale deed dated 14.12.2012. It was registered as Document No.3350/2012 on the file of the second respondent. Subsequently, a rectification deed was also executed. While so, the petitioner wants to sell the property. Sale deed dated 29.05.2025 was executed in favour of 2/5
one Kavitha. The document was presented for registration. The registering authority declined to register the document on the ground of double entry. It is seen that the third respondent had executed a sale deed dated 25.09.2013 in favour of the fourth respondent. The respondents 3 and 4 have not chosen to oppose the writ prayer. 3.Admittedly, the settlement deed in favour of the fourth respondent was executed after the purchase of the property by the writ petitioner. That apart, the revenue record stands in the name of the writ petitioner's vendor.
4.It was held vide order dated 23.04.2025 made in W.P(MD)No. 11299 of 2025 (Amulraj Vs The Sub Registrar, Office of Sub Registrar, Sanarpatt, Dindigul District), on the ground of double entry, registration cannot be refused. Yet another order in favour of the writ petitioner is one dated 17.12.2024 rendered in W.P(MD)No.22114 of 2024 (T.Senthilvel Vs District Registrar (Administration) and two others). Applying the approach adopted above in those writ petitions, the impugned refusal check slip is quashed. The parties are permitted to 3/5
re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities.
