ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to conduct an inspection of the compound wall constructed with solid cement concrete blocks, along with the overhead barbed-wire steel fencing situated in the petitioner's property comprised in S.F.No. 38/5 at Valayankulam Village, Thirupparankundram Taluk, Madurai District, and consequently modify the compensation awarded in Final Award No.18 of 2025 in Na.Ka.No.11/2023/SH1 dated 17.11.2025 passed by the second respondent, and thereafter refer the matter to the Principal District Judge/Land Acquisition, Rehabilitation and Resettlement Authority, Madurai, as expeditiously as possible. 2/5
2. The petitioner is claiming right over the property comprised in S.F.No.38/5. The said property was acquired by the respondents for the purpose of laying highway. The contention of the petitioner is that adjacent land owners had compound walls constructed with hollow blocks and the petitioner's property was enclosed by a compound wall made of solid cement concrete blocks with overhead barbed-wire steel fencing. However, the respondents have not taken the said facts into consideration and fixed the lesser compensation amount. It is further submitted that the award has already been placed for reference before the competent District Court. Now, the petitioner is seeking to inspect the said place and submit a report.
3. Considering the limited relief sought in the prayer, this Court is inclined to entertain the writ petition. Therefore, the concerned official respondent is directed to inspect the subject property after issuing notice to the petitioner. On completion of the inspection, the official respondent shall submit an inspection report to the second respondent. The second respondent shall consider the inspection report and forward the same to the District Court concerned. Until such exercise is completed, the respondents shall not demolish the compound wall and fencing. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
