BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 09.07.2025
CORAM:
THE HONOURABLE MR.JUSTICE S.M.SUBRAMANIAM and THE HONOURABLE DR.JUSTICE A.D.MARIA CLETE S.Jayakumar ... Petitioner -vsThe District Collector Karur District Karur ... Respondent PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondent to take necessary and appropriate action by considering the petitioner's representation (TN/HOMEEXC/KAR/I/COLLMGDP/25MAR25/11339245) dated 24.03.2025 to the respondent for removing these TASMAC Bars. For Petitioner :
Mr.M.Selvakumar For Respondent :
Mr.P.Thilakkumar Government Pleader
O R D E R
[Order of the Court was made by S.M.SUBRAMANIAM, J.] Mr.P.Thilakkumar, learned Government Pleader, takes notice for the respondent.
2. With the consent of both sides, this writ petition is taken up for final hearing at the admission stage itself.
3. The prayer sought for in this writ petition is vague and even to consider the representation of the petitioner, he has to establish his rights or to state about infringement of his rights. A general representation would not provide a cause for filing a writ petition, unless some public interest is involved. In the present case, the petitioner has not even impleaded the proper and necessary party as a party respondent. The averments made in the representation submitted by the petitioner seem to be general in nature. Thus, the petitioner is at liberty to give a specific complaint regarding the shifting or opening of a TASMAC Shop in a particular area to the authority concerned and in the event of receiving any such specific complaint, the same is to be considered by the authority concerned in accordance with law.
4. With the above observation, this writ petition is disposed of. No costs.
