ORDER

The petitioner is before this Court seeking for a direction to the respondents to release the petitioner's Additional Security Deposit deposited by the petitioner in connection with tender Notification in Kuzhithurai Municipality TURIF 2025-26.

2. The petitioner was declared as the successful bidder and he was awarded the contract under the said tender document and as per the terms of the agreement, the petitioner claims to have deposited Additional Security Deposit. After completion of the work satisfactory, the petitioner was under an obligation to release the Additional Security Deposit deposited by the petitioner. However, as of today, the respondents have not released the amount without any valid reasons.

3. The learned Standing counsel for the second respondent submitted that the petitioner had executed only a term deposit bond in the Union Bank of India, Marthandam and hence, it is a bank guarantee. 2/6

4. However, the learned counsel for the petitioner refused the said contention stating that in addition to the bank guarantee, the petitioner had also deposited the Additional Security Deposit amount.

5. The submissions made by either side counsel have been duly considered.

6. This Court, without expressing any opinion on merits and demerits of the claims of the parties, disposed of this Writ Petition directing the second respondent to consider the petitioner's representation dated 09.06.2026 on its own merits and pass an appropriate orders in accordance with law within a period of four weeks from the date of receipt of the copy of this order.
