For Respondent : Mr.M.Muthumanikkam Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.115/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 306 of IPC in Cr.No.115 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant's brother and the petitioner's daughter were loved each other and married 15 years ago and lived separately. When the defacto complainant's mother was questioned the petitioner's daughter for using mobile phone, the petitioner's daughter consumed poison and attempted to suicide. She was treated and discharged from the hospital. Therefore, the petitioner herein has went to the house of the defacto complainant's mother and shouted her that she is the reason for her daughter's attempt to suicide and scolded the defacto complainant's mother in filthy language. Due to this incident, the defacto complainant's mother consumed poison and died. Hence the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case and pray the petitioner to be released on anticipatory bail. 4.The learned Government Advocate(Crl.side) submitted that the defacto complainant's mother consumed poison at the instigation of the petitioner and pray the petition to be dismissed. 5.Considering the facts and circumstances of this case and considering the nature of offence this Court is not inclined to grant anticipatory bail to the petitioner.
