PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus forbearing the respondents from in any way disturbing the Petitioner's peaceful possession of the property situated in S.No. 193/89 in Keelaiyur Village, Ilayangudi Taluk, Sivagangai District and by considering the Petitioner's representation in pursuant to the proceedings, dated 11.5.2021 in the light of the order passed by this Court in W.P(MD)No.9335 of 2013 vide order dated 3.8.2022 within the time stipulated by this Court. O R D E R

The Writ Petition is filed seeking issuance of a Writ of Mandamus forbearing the respondents from disturbing the Petitioner's peaceful possession and enjoyment of the property situated in S.No.193/89 in Keelaiyur Village, Ilayangudi Taluk, Sivagangai District by considering the Petitioner's representation, dated 11.5.2021.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.It is the case of the Petitioner that the subject property has been in possession and enjoyment of the Petitioner with revenue 2/6

records in his name. All of a sudden, the respondents installed boards with an intention to disturb the possession of the Petitioner. Therefore, the petitioner submitted a representation objecting the installation of boards in the Petitioner's property. The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.

4.Mr.M.Gangatharan, learned Government who appears for the respondents 1 to 4 would submit that the representation submitted by the Petitioner will be considered on its own merits within the time stipulated by this Court.

5.A perusal of the typed-set of papers filed by the Petitioner would show that the Petitioner has failed to produce any acknowledgment for having submitted a representation before the respondents.

6.In these circumstances, without expressing any opinion on the merits of the matter, the Petitioner is directed to submit a fresh representation to the fourth respondent within a period of four weeks from the date of receipt of a copy of this order. On submission of fresh representation by the Petitioner, the fourth 3/6

respondent is directed to consider the said representation of the Petitioner and pass orders on its own merits, within a further period of 8 weeks from the date of receipt of representation from the Petitioner..

7.With the above directions, the Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
