ORDER

The petitioner has filed this petition seeking police protection. 2.The petitioner claims that he has filed a writ petition in WP. (MD)No.27928 of 2024 as against water body encroachment in Samuthirakulam in Survey No.53/2, Kallalankudi Village, Alangudi Taluk, Pudukkottai District. The said writ petition was allowed by this Court on 22.11.2024 directing the Block Development Officer, Thiruvarankulam Panchayat Union, to remove the encroachment within a period of six months. The petitioner with a grievance that the orders of 2/6

this Court in WP.(MD)No.27928 of 2024 has not been complied with, has filed a contempt petition in Cont.P.(MD)No.1619 of 2025. In the said contempt petition, this Court directed the Block Development Officer to submit a status report, on or before 10.07.2025. 3.In these circumstances, the petitioner has lodged a complaint before the respondent Police that in the mid night two persons have come to his house and searched for him. The petitioner has also lodged a complaint before the Deputy Superintendent of Police, Alangudi and the same was forwarded to the respondent Police on 16.06.2025. 4.The learned counsel appearing for the petitioner, by relying on the paper publication, submits that there are more than 200 encroachments in the water body and the encroachers are preventing the officials from removing the encroachment and also conducted road-roko. Therefore, the petitioner claims that his life is in danger at the hands of the encroachers.

5.The learned Government Advocate(Crl.side) appearing for the official respondents submits that the compliant of the petitioner was enquired and allegation in the complaint is that two persons have come 3/6

to his house at mid night and also searched for the petitioner. The Deputy Superintendent of Police has also deputed two Police constables for surveillance in the petitioner's area.

6.This Court has considered the submissions made on either side and perused the available records.

7.Admittedly, the petitioner has filed a writ petition and also obtained an order to remove encroachment in Samuthirakulam in Survey No.53/2, Kallalankudi Village, Alangudi Taluk, Pudukkottai District. The petitioner claims that there are more than 200 encroachment and there are encroachers are preventing the officials from remove encroachment for more than six months. Therefore, the petitioner has filed contempt petition. In these circumstances, the petitioner has received life threat and therefore, it is the responsibility of the respondent Police to provide Police protection and ensure the safety of the petitioner.
