ORDER
Heard the learned counsel on either side.
2. The petitioner challenges the impugned order passed by the second respondent whereby a request for issuance of patta had been denied.
3. The learned Additional Government Pleader appearing for the respondents has produced the copies of the revenue records which indicate that the property in question is a water body. The Hon'ble Apex Court as well as the Madras High Court have been repeatedly holding that there cannot be any assignment in respect of the water bodies. The learned counsel appearing for the petitioner asserts that he has a civil court decree in his favour.
4. It is true that the decree of injunction has been granted in O.S.No.147 of 1983 on the file of the District Munsif Court, Uthamapalayam. I went through the pleadings set out in the said judgment. There is a clear indication therein that the petition mentioned property is a water body. In the said civil 2/4
suit, the Government was not a party. Therefore, the said decree will not bind the Government .
5. In these circumstances, the impugned order passed by the second respondent cannot be faulted. I do not find any ground to interfere. The Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
