ORDER

The petitioner herein seeks a direction to the second respondent to conduct survey of the property purchased by him in old S.Nos.787, 787/2, 787/2E or new S.No.60/8 located in Suthamalli Village, Tirunelveli Taluk, Tirunelveli District, by considering his on-line application No.2024017829000180, dated 03.07.2024 .

2. Heard the arguments of Mr.D.Arul Prakash, learned counsel for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4. According to the petitioner, the subject property was purchased by him under registered sale deed, dated 16.08.2023. He submitted an on-line application on 03.07.2024, seeking survey of the property. The same has not been considered. Hence, the petitioner has come before this Court.

5. The learned Additional Government Pleader, who takes notice for the respondents would submit that the petitioner is one of the purchaser under the document, dated 16.08.2023. In such circumstances, the application of the petitioner will be considered after issuing notice to the co-owners.

6. In view of the same, without expressing any opinion on the merits of the matter, the respondents are directed to consider the petitioner's application No.2024017829000180, dated 03.07.2024 and pass final orders on its own merits, within a period of 12 weeks from the date of receipt of copy of this order after issuing notice to the petitioner, co-owners, neighboring land owners and other interested parties.

7.With the above direction, this Writ Petition stands disposed of. No costs.
