PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 5th respondent to reimburse a sum of Rs.70,922/- (Rupees Seventy thousand Nine hundred and Twenty Two Only) towards the balance sum payable to the petitioner spend by him towards medical treatment within a time fixed by this Court.

ORDER

The petitioner has made a claim for medical reimbursement under the New Health Insurance Scheme, has filed the writ petition seeking to reimburse a sum of Rs.70,922/- towards the balance amount payable to the petitioner towards medical reimbursement.

2. The learned counsel for the petitioner submitted that the petitioner is a retired employee and a beneficiary under the NHIS and he has undergone a surgery by incurring a sum of Rs.1,35,638/-. Despite the petitioner has made a claim for Rs.1,35,638/-, he was given with only 2/5

a sum of Rs.64,760/- without stating a reason for balance amount. Unless any reasons are assigned for not sanctioning the remaining balance, it is very difficult for the petitioner to invoke the appeal remedy.

3. Since the petitioner has already given a representation in this regard, the respondents are directed to pass a reasoned order as to why the remaining amount of Rs.70,922/- is withheld and reimburse, in case, if the petitioner is eligible for the balance amount. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above direction. No costs.
