PRAYER :- To enlarge the petitioner on bail in C.C.No. 05 of 2019 on the file of the Learned II Additional District Judge (CBI Cases) Madurai in Crime No. 4 of 2011 on the file of the respondent police and thus render justice. 1/4

ORDER : The Court made the following order :- The petitioner, who arrayed as accused, was arrested and remanded to judicial custody on 01.07.2024 for the offences punishable under section 450 IPC and under Sections 406,420, 120(B) IPC and Section 5 of Tamil Nadu Protection of Interest and Depositors Act (Financial Establishment) Act, 1997 in Crime No.4 of 2011 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein has involved in alleged offence of cheating of Rs.2,77,71,900/- and he was absent for the past 10 years before the trial Court in C.C.No.5 of 2019 on the file of the additional District Judge (CBI Cases) Madurai and hence, NBW was issued on 15.11.2014.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that there are 215 victims are involved in this case and if the petitioner is released on bail he may tamper the witnesses and may abscond and he strongly opposed to grant bail to the petitioners.

4. Considering the facts and circumstances of the case and also considering serious nature of allegations made against the petitioner, this Court is not inclined to grant 2/4

bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. The trial Court is directed to complete the trial process within a period of two months from the date of receipt of a copy of this order.
