O R D E R
The Petitioner herein seeks a direction to the first respondent to cancel the patta transfer order issued by the second respondent in respect of the land situated in S.No.554/1A situated at Keezhakarai Village and Taluk, Ramanathapuram District by considering his representation, dated 7.5.2022. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, the subject property originally belongs to her mother and the Petitioner claims right over the subject property under Gift Deed executed by her mother, dated 30.05.2008. It is the further case of the Petitioner that the father of the third respondent and brother of the Petitioner namely, Imthias Ahamed obtained patta transfer order by producing bogus documents. Therefore, the Petitioner made a representation before the first respondent on 7.5.2022 seeking cancellation of patta transfer order. It is also stated by the Petitioner in the representation that the application allegedly submitted by the 2/6
Petitioner's brother was prior to the constitution of the Taluk Office in Keezhakarai. Since the representation of the Petitioner has not been considered till date, the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.Mr.A.Baskaran, learned Additional Government Pleader who appears for the respondents 1 and 2 would submit that the competent authority to consider the Petitioner's representation is the Revenue Divisional Officer, Ramanathapuram and that the representation submitted by the Petitioner will be considered by the said authority on its own merits within the time stipulated by this Court.
5.In view of the same, without going into the merits of the case, the first respondent is directed forward the representation of the Petitioner, dated 7.5.2022 to the competent authority namely, the Revenue Divisional Officer, Ramanathapurm within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the above said authority shall consider the representation of the Petitioner, dated 7.5.2022 and pass orders on its own merits after issuing notice to the Petitioner third respondent and other legal heirs of Imthias Ahamed within a period of 8 weeks from the date of receipt of 3/6
representation from the first respondent.
6.With the above directions, the Writ Petition stands disposed of. No costs.
