ORDER : The Court made the following order :- The petitioner/2nd accused, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B), 29 (1), 25 of NDPS Act, 1985 in Crime No.224 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 1.250 kgs of ganja. Hence, the case. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.13435 of 2023 3.Heard both sides and perused the materials available in the record. 4.It is seen that this is third petition for anticipatory bail without any change of circumstances. Further it is submitted that on the date of occurrence, the third accused was arrested on the spot along with contraband and based on the confession statement of him only, involvement of this petitioner came to be light. Even though it has been submitted by the petitioner that there is no previous case pending against the petitioner, considering that there is no change in circumstances. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
