RESPONDENTS/RESPONDENTS/COMPLAINANTS Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extent the time for a further period of 6 months to complete the investigation and to file a final report as per the directions given by this Madurai Bench of Madras High Court,Madurai by its order dt.5/10/2021 made in Crl.OP(MD)No.15121/2021. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.MEENAKSHI SUNDHARAM, Additional Public Prosecutor, for the petitioner and of M/S.D.
DEEPAMATHI,Advocate on behalf of the Respondent, the court made the following order:- The learned Additional Public Prosecutor had filed this Petition on behalf of the Superintendant of Police, Trichy District and the Inspector of Police, District Crime Branch, Trichy District seeking extension of time for completing the investigation. He had submitted that there were 13 accused in this case, in which, nine accused had been arrested and four accused still absconding. It is the case, where the accused have been forged the documents and the Defacto Complainant is the original owner of the property. The accused alleged to have been forged the Defacto Complainant and sold the property. Therefore, the Defacto Complainant had approached the District Crime Branch, Trichy. After registration of the case, the investigation had not proceeded.
Therefore, the Defacto Complainant had approached the Court to file the Crl.O.P(MD) No.15121 of 2021 and as per the order passed by the learned Single Judge of this Court dated 05.10.2021, the Investigation Officer was directed to complete the investigation within a period of six months from the date of receipt of copy of this order and after filing the Final https://www.mhc.tn.gov.
CRL MP(MD) No.12576 of 2022 Report, the compliance report must be sent to the Registry. With the above direction, the Crl.O.P(MD) No.15121 of 2021 was disposed of. 2.After one year of the order passed by the learned Single Judge of this Court, the Investigation Officer had approached this Court seeking extension of time to complete the investigation. 3.The learned Counsel for the Respondents object to the submission of the learned Counsel for the Petitioners. 4.The learned Additional Public Prosecutor submits that the copy of the order was received belatedly and also after the investigation was proceeded, fairly the Investigation Officer was in Medical Leave and subsequently she was transferred. The present Investigation Officer had taken charge as Inspector of Police, Anti Land Grabbing Cell only on 15.07.2022.
Accordingly, the new Investigation Officer had taken steps to address the absconding accused and also the signature as well as the thump impression of the accused were sent for the forensic laboratory and the forensic report are awaited. Anyhow, the learned Additional Public Prosecutor seeks further time of three months to complete the investigation. 5.In the light of the submission of the learned Additional Public Prosecutor, further period of two months is granted to the Investigation Officer to complete the Investigation and to file the Final Report.
