This Writ Petition has been filed to call for the records pertaining to the impugned order passed by the 2nd respondent vide his proceedings dated 17.07.2023 and quash the same as illegal and consequently, directing the respondents to grant permission and necessary protection to conduct Street Play cultural programme on 25.07.2023 in purusant to "Mulaipaari Thiruvizha" at Sri Muthumariamman Kovil situated at Venthoni Village, Paramakudi,

2. It is submitted by the learned counsel for the petitioner that last year both the petitioner and newly impleaded parties have conducted the festival independently. It is submitted that the representation submitted by the petitioner was rejected by the 2/5

respondents police on the ground that earlier First Information Report was registered regarding the festival.

3. Now, it is submitted by the respondents police that in case of both the groups are coming forward jointly no objection to grant suitable protection.

4. It is submitted by the un-official respondent, who was impleaded, that in the meeting before the Thasildar, they have suggested to conduct the festival jointly, for which, the petitioner has raised objection and came out and thereby, no consensus could not be arrived at.

5. Since two criminal cases said to have been registered in the last year, if the petitioner and the respondent intends to perform the festival jointly the function can be permitted to be conducted.

6. Accordingly, the petitioner is directed to approach the police again with the fresh request along with persons belonging to the 3/5

other group / impleaded parties, with a request that they are willing to jointly conduct the programme. On filing of an application, the respondents Police are directed to consider the same.

7. With the above direction, this Writ Petition is disposed of. No costs.
