Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL UNDER SEC 482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.67 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 279, 337 and 304(A) of IPC, in Cr.No.67 of 2023, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is the wife of the 1/3

deceased. When the deceased and his son were proceeding towards to the house of the deceased's mother in their bike, a bike, which was coming in opposite direction in a rash and negligent manner, dashed against the deceased's bike. The deceased died on the spot and his son has sustained injuries. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the injured was discharged from the hospital and no previous case is pending against the petitioner. Hence, he prays for grant of anticipatory bail to the petitioners. 4.The learned Additional Public Prosecutor would submit that the investigation is in preliminary stage. Hence, he vehemently, opposed to grant anticipatory bail. 5.Considering the facts and circumstances of the case and also considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner with certain conditions.
