O R D E R

The matter had been listed under the caption "for being spoken to", as this Court was of the view that the petitioner would be entitled for terminal benefits other than pension and DCRG, which could be restricted by way of a punishment under the Tamil Nadu Pension Rules.

2. In view of the same, the paragraph 6 of the order dated 13.10.2025, shall be struck off and the same shall be replaced by the following:-

For the aforesaid reasons, the Writ Petition stands allowed as the petitioner is deemed to have been retired from service and the respondents are directed to disburse of all other terminal benefits except for withholding the DCRG and the pension within a period of eight weeks from the date of receipt of a copy of this order. The respondents are also directed to take a decision as to whether they propose to proceed 2/4

further any disciplinary proceedings within a period of 12 weeks from the date of receipt of a copy of this order and if so, they are also directed to complete such disciplinary proceedings within a period of three months thereafter. If they decide not to proceed with any departmental proceeding, then the remaining terminal benefits shall also be paid to the petitioner within a period of four weeks therefrom and pay the eligible pension to the petitioner from the date of his superannuation. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
