Mr.R.M.Anbunithi, Additional Public Prosecutor. PETITION FOR BAIL Under Sec.483 of B.N.S.S. U/s 439 of Cr.P.C. PRAYER :- For Bail in Crime No.166 of 2024 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 30.05.2024 for the offence punishable under Sections 307 & 302 IPC altered into Sections 307, 302, 114 and 34 IPC in Cr.No.166 of 2024 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the accused persons assaulted the defacto complainant's husband and hence, he was admitted in the Government Hospital. The accused persons came to the hospital and again started to attack him with aruval 1/3
and the defacto complainant's son intervened, due to which, he died. Hence, the case. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 30.05.2024, hence he may be released on bail.
4.The learned Additional Public Prosecutor would object to grant bail to the petitioner on the ground that the accused persons two times tried to attack the defacto complainant's husband and in the second attempt, when the defacto complainant's son prevented them from the attack, the accused person attacked him with aruval in his head, due to which, he died. 5.Considering the gravity of the offence committed by the accused and also considering the objection raised by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
