ORDER

The petitioner has come up with the above writ petition seeking for the issue of a writ of mandamus, to direct the respondent to implement the clarification issued by the Chief Engineer (AE) vide letter Panam1/48828/10 dated 19.05.2011 by considering the petitioners representation dated 24.08.2015. 2.It is submitted that excess payments are recovered from the Assistant Engineers since audit objection was raised and in this regard, clarification has also been given to the respondent. Therefore, the petitioner made representation dated 24.08.2015 to the respondent to implement the said clarification. Since no order has been passed, the petitioner has come up with the above writ petition.

3.Considering the above stated facts and circumstances and without going into the merits of the case, the writ petition is disposed of directing the respondent to consider the representation of the petitioner dated 24.08.2015 and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
