For Respondent : M/s.A.Thiruvadi Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.320 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused No.3 & 4, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 354, 323 and 506(i) IPC @ under Sections 354, 323 and 506 (i) IPC and Section 4 of TNPHW Act and Section 11(i) r/w 12 of POCSO Act in Crime No.320 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 15.04.2021 at about 10.00 a.m. during the Village festival, the accused persons have tried to abduct the defacto complainant's daughter for forcible marriage with A1 and when the defacto complainant and her relatives https://hcservices.ecourts.gov.in/hcservices/

tried to prevent the same, the accused persons assaulted them and criminally intimidated them. Hence, the complaint. 3.The learned counsel for the petitioners submit that the petitioners are innocents, they have not committed any offence as alleged by the prosecution, but they have been falsely implicated in this case.

4. Heard the learned Additional Public Prosecutor appearing for the respondent Police.

5. It appears that this is the second application for anticipatory bail and the earlier anticipatory bail application filed by the petitioners in Crl.O.P(MD).No.12290 of 2021 was dismissed on 15.09.2021 on the ground that the petitioners have abducted the victim girl, conducted forcible marriage between the victim and A1, outraged her modesty and damaged her clothes. Now, this application is filed by the petitioners without referring the change of circumstances to consider the case.

6. Since there is no change of circumstance and considering the antecedents of the petitioners, this Court is not inclined to entertain this Criminal Original Petition and the same is accordingly dismissed.
