For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.1045/2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as A1, apprehending arrest at the hands of the respondent police for the offence punishable under Section 379 IPC., and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.1045 of 2020, on the file of the respondent Police, seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

3.This is the second anticipatory bail petition. Earlier, the petitioner has filed a anticipatory petition in Crl.O.P(MD)No.13865 of 2020 and the same was dismissed on 03.12.2020 on the ground that the petitioner said to have illegally transported five units of river sand by using lorry.

CRL OP(MD).No.15660 of 2020 4.Taking into consideration the fact that there is no change in circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
