ORDER

This writ petition has been filed seeking for a direction to the 1st and 2nd respondents to permit the petitioner and his villagers for conducting festival celebrations of Sri Selva Vinayagar temple, Sri Pattani temple, Sri Munnodu Karuppu Temple, Sri Kaaliyamman temple and Sri Maariyamman Temple situated at Paatiyur Village, Moolapaatiyur, Vedasandur Taluk, Dindigul District, with adequate police protection from 05.07.2026 to 07.07.2026 and considering the petitioner's representation dated 16.06.2026.

2. The learned counsel for the petitioner submitted that the petitioner made a representation seeking adequate police protection for the festival of the aforesaid temple. Since the same was not considered, the petitioner is before this Court.

3. The learned Government Advocate (Crl.side) submitted that the representation of the petitioner is pending consideration.

4. Heard the learned counsel on either side and carefully perused the materials available on record. Since no adverse order is proposed to be passed against the third respondent, notice to him is dispensed with. 2/4

Considering the facts and circumstances of the case, the second respondent police is directed to issue notice to the petitioner as well as the third respondent under Section 64 of the BNSS, conduct an enquiry, and take appropriate steps to facilitate the peaceful conduct of the temple festival forthwtih.

6. It is made clear that no villagers shall be prevented from participating in the temple festival. The festival organizers shall receive the temple tax from all the villagers without discrimination. No family residing in the village shall be excommunicated or excluded from participation in the festival on any ground. Further, no individual or group shall insist upon or claim any first honours in connection with the festival. The respondent police is directed to provide necessary police protection to the petitioner for the conduct of the festival, subject to payment of the requisite charges, in accordance with G.O.Ms.No.139, Home (Pol-VIII) Department, dated 04.03.2019.

7. With the above direction, this writ petition stands disposed of. 23.06.2026 NCC : Yes / No Index : Yes / No Note: Issue order copy on 25.06.2026.
