O R D E R

The present Writ Petition is filed for issuance of a Writ of Mandamus directing the third and fourth respondents to conduct a survey of the petitioner's lands comprised in Natham S.Nos.382/23 and 382/24, to the extents of 0-2.18 hectare (2347 sq.ft.) and 0-2.41 hectare (2595 sq.ft.), respectively, situated at Pagalavadi Village, Thuraiyur Taluk, Trichy District and consequently direct the first to fourth respondents to issue a proper FMB Sketch for the said lands within a time frame to be fixed by this Court.

2. The petitioner is claiming rights over the properties comprised in Natham S.Nos.382/23 and 382/24, to the extents of 0.0218 hectare (2347 sq.ft.) and 0.0241 hectare (2595 sq.ft.), respectively, situated at Pagalavadi Village, Thuraiyur Taluk, Trichy District. The petitioner Page No. 2 of 6

claims that the said properties are ancestral properties. The petitioner's father, namely, Perumal, was in possession and enjoyment of the same and pattas stood in his name in Patta No.891 for the property in Natham S.No. 382/23 and in Patta No.576 for the property in Natham S.No.382/24. The petitioner's father died and the petitioner, being the sole legal heir, is entitled to the said properties.

3. However, it is seen from the records filed before this Court that the petitioner has not stated whether he is the sole legal heir or whether any other legal heirs are available. Therefore, this Court is directing the petitioner to submit the relevant records before the third respondent, who shall, in turn, consider the same and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order.

In case the third respondent is coming to the conclusion that the petitioner is entitled to seek survey of the properties, the petitioner's survey application shall be considered after issuing notice to the petitioner, any other legal heirs, if any and the fifth respondent and thereafter the survey shall be conducted within a period of twelve weeks from the date of receipt of a copy of this order. 5. If the Tahsildar, the third respondent, is seeking police protection, the jurisdictional police shall provide the necessary police protection.

6. While conducting the survey, the official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. Page No. 4 of 6

7. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
