Respondents Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the second respondent to dispose the petitioner's representation, dated 05.04.2024 to cancel the patta stands in the name of the respondents 4 and 5 and consequently, issue patta in his name in respect of patta No.1140 situated at Thiruppangali South Revenue Village, Mannachanallur Taluk, Trichy District.

ORDER

The petitioner herein seeks a direction to the second respondent to dispose of his representation, dated 05.04.2024, seeking cancellation of patta issued in the name of the respondents 4 and 5.

2. Heard the arguments of Mr.K.Arunraj, learned counsel for the petitioner and Mrs.S.Jeya Priya, learned Government Advocate appearing for the respondents 1 to 3.

3. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.

4. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

5. According to the petitioner, patta for the subject properties situated in S.Nos.518/6, 519/9, 521/15, 521/7, 522/15, 523/5, 523/6 and 524/3A in Thiruppangali South Revenue Village, Mannachanallur Taluk, Trichy District, originally stood in the name of the petitioner's father Peran S/o.Mookan in Patta No.1140. Now the patta for the subject property is wrongly mutated in the name of the respondents 4 and 5. Hence, the petitioner submitted a representation, dated 05.04.2024, seeking cancellation of patta issued in the name of the respondents 4 and 5 and inclusion of the heirs of the petitioner's father Peran. The same has not been considered. Hence, the petitioner has come before this Court.

6. The learned Government Advocate, who takes notice for the respondents 1 to 3 would submit that the representation submitted by the petitioner will be considered in accordance with law.

7. In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation of the petitioner, dated 05.04.2024 and pass final orders on

its own merits, within a period of 12 weeks from the date of receipt of copy of this order after issuing notice to the petitioner and respondents 4 and 5. 8.With the above direction, this Writ Petition stands disposed of. No costs.
