: Respondent PRAYER :- Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, to direct the respondent to hand over the Form-29 (Transfer of Owneship) and the duplicate key of the petitioner's Toyota Innova Car bearing Registration No. TN-59BB-7821 and to remove the wrong entry made in the CIBIL(Credit Information Bureau (India) Limited) Credit Score records showing pending loan due of Rs.39, 577/- payable by the petitioner to the respondent which is already paid to the respondent. ORDER

Heard the learned Counsel for the petitioner and the learned Counsel for the respondent.

2.The petitioner's grievance is that he availed vehicle loan from the respondent Bank way back in the year 2013 and that he has cleared the said loan. The grievance of the petitioner is that when he approached another Bank for availing a fresh loan, CIBIL entry has been made, as if the petitioner owes money to the respondent bank. That necessitated the filing of this Writ Petition.

3.When the matter was taken up for disposal, the learned Counsel for the respondent made a categorical statement that the respondent has no claim against the petitioner as of now, as all the liabilities have been cleared by the petitioner. The https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.19457 of 2020 respondent bank has also written to CIBIL for removing the entries raised at their instance against the petitioner herein. 4.I am of the considered view that this statement should be more than sufficient for the petitioner herein. It is, ofcourse, open to the petitioner, if the CIBIL entry reflects his name, to write to CIBIL for removal of the same by enclosing this order copy.

5.The learned Counsel for respondent Bank states that he will hand over the duplicate key of the petition mentioned car to the learned Counsel for the petitioner at the earliest. 6.Recording the said submissions, this Writ Petition is disposed of. No costs.
