JUDGMENT

(By G.R.SWAMINATHAN, J.) The State has filed this writ appeal assailing the order dated 23.04.2019 made in W.P.(MD)No.4549 of 2017. A mere look at the said order would show that it relies solely on the order dated 01.03.2018 made in W.A.(MD)No.1494 of 2017. It is now brought to our notice that the State has filed Civil Appeal No.12310 of 2024 before the Hon'ble Supreme Court questioning the aforesaid decision of the Hon'ble Division Bench dated 01.03.2018 in W.A.(MD)No.1494 of 2017. The Hon'ble Supreme Court set aside the order passed by the Hon'ble 2/6

Division Bench. Thus, the basis on which the impugned order passed by the learned Single Judge has been totally undermined. The learned senior counsel states that he has other submissions to urge in support of his case. If that be so, the matter will have to go before the learned Single Judge for fresh consideration and disposal. 2.In this view of the matter, the order impugned in the writ appeal is set aside and the matter is remitted to the file of the learned Single Judge for fresh disposal. The Registry shall place the writ petition before the learned Single Judge holding the roster.
