ORDER
This Criminal Original Petition has been filed to modify the condition imposed in Crl.M.P.No.3552 of 2023, dated 23.6.2023, on the file of the learned Principal Sessions Judge, Thanjavur, in which, the petitioner was directed to deposit Rs.1,50,000/- to the credit of Crime No.391 of 2023. 2.The learned counsel for the petitioner would submit that his wife/A2 was granted bail in Crl.M.P.No.3636 of 2023 and she was directed to deposit Rs.1,50,000/-, thereby, she has also deposited the same and released on bail. On the same day, the petitioner has also moved anticipatory bail in Crl.M.P.No.3552 of 2023 and it was granted with a condition to deposit Rs.1,50,000/- to the credit of crime number. Since the petitioner has already deposited amount for his wife, who is arrayed as A2, he could not mobilise fund.
Hence, prays to modify the condition. 3.It is seen that the subject amount involved in this case is Rs.3,67,000/-, since the petitioner's wife/A2 has already deposited Rs.1,50,000/-, the petitioner/A1 was also imposed with a condition to deposit Rs.1,50,000/-. Considering the nature of offence only the trial Court has imposed such a condition.
