PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, calling for the records of the impugned order of the 1st Respondent in P.G.A.No. 1 of 2017 dated 15.05.2017 and quash the same as illegal. ORDER

Read this order in conjunction with order dated 30.11.2021 that reads as follows:

"As against the gratuity due of a sum of Rs.17,000/- [approximately] with interest of Rs.40,000/- [approximately] amounting to a total amount of Rs.57,000/-, the employer, as a special case, is willing to consider the settlement of the claim at a sum of Rs.40,000/-.

2. Let the third respondent obtain instructions from his client and let both parties file memos, if this arrangement finds favour with them.

3. List the matter on 02.12.2021."

2.Parties report settlement of the matter and an affidavit is filed by the contesting respondent/R3 to the effect that two cheques bearing Nos.003080 and 003081 for amounts of Rs.6,326/- and Rs.33,674/- respectively, totalling to Rs.40,000/-, are handed over to the learned counsel for R3 for onward transmission to R3. 3.The petitioner has filed a memo dated 01.12.2021 to the same effect and seeking withdrawal of this Writ Petition. 4.In the light of the aforesaid settlement, this Writ Petition is closed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
