O R D E R

The Writ Petition is filed seeking a direction to the second respondent to disburse the compensation amount in respect of the Petitioners land in R.S.No.267/1 in Keelakurichi Village acquired for the purpose of expansion of Trichy Airport. 2.Mrs.S,Jeya Priya, learned Government Advocate takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.side) takes notice for the third respondent. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself. 3.It is not in dispute that 0.02.50 ares of Petitioners land in 2/6

the above mentioned Resurvey number was acquired for the purpose of expansion of Trichy Airport and an award was passed by the second respondent on 19.7.2024 fixing the compensation payable to the Petitioner at Rs.57,044/-.The said amount has not been paid to the Petitioners on the ground that the petitioners failed t produce the original title documents. 4.It is the case of the Petitioners that the subject property was purchased by the Petitioners father under sale deed, dated 1.7.1959. Patta for the subject property stands in the name of Petitioners in Patta No.1657. The original title document was misplaced by the Petitioners and hence, a Police complaint was lodged on 1/7/2023 before Ponmalai Police Station, Tiruchirappalli and obtained a receipt. The Petitioners submitted a representation on 9.4.

2025 before the second respondent seeking disbursement of the compensation amount. The same has not been considered till date. Hence the Petitioners are before this Court with present Writ Petition for the relief stated supra. 5.Mrs.S.Jeya Priya, learned Government Advocate who takes notice for the respondents 1 to 3 would submit that the Petitioners failed to produce the original title document .Therefore, the compensation amount has not been disbursed to the petitioners.

6.It is the specific case of the Petitioners that the title document of the subject property in favour of Petitioners father was misplaced and they have also lodged a police complaint in this regard and obtained a receipt.

7.In these circumstances, if the Petitioners are able to produce the certified copy of the title document and police complaint with receipt, there will not be any impediment for the second respondent to disburse the compensation amount by getting an affidavit from the Petitioners regarding the misplacement of the original title document.

8.Therefore, the second respondent is directed to consider the representation of the Petitioners, dated 9.4.2025 positively and disburse the compensation amount to them within a period of four weeks from the date of receipt of a copy of this order. 9.With the above direction, the Writ Petition stands disposed of. No costs.
