For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory Bail in Crime No. 8 of 2019 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner apprehends arrest at the hands of the respondent for the offences under Sections 498(A), 294(b) and 506(i) of IPC in Crime No.08 of 2019. He seeks anticipatory bail. 3.The petitioner got married to the defacto complainant on 30.11.2009. A male child was also born. The defacto complainant left the petitioner along with the child. The petitioner has since filed a petition for restitution of conjugal rights and is still pending.

The petitioner is willing to deposit a sum of Rs.3,000/- as maintenance. It is only an interim arrangement and that will be subject to final order passed by the jurisdictional Court. 4.Taking note of the offer made by the petitioner and his https://hcservices.ecourts.gov.

CRL OP(MD). No.12353 of 2019 conduct, this Court is inclined to grant anticipatory bail with the condition that the petitioner would arrange to deposit a sum of Rs.3,000/- in the Bank account of the defacto complainant. Hence, anticipatory bail is granted. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District Munsif cum Judicial Magistrate, Vedasanthur, Dindigul District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
