O R D E R

The petition has been filed to direct the respondents 2 and 3 to provide adequate police protection for celebration of Annai Velankanni Gurusadi Festival of Sacred Heart Church, Irudhayakulam from 04.09.2019 to 08.09.2019 at Survey No.385/2 New Survey No.1370, Vikramasingapuram, Ambasamudram Tk. Tirunelveli District 2.

The learned counsel for the petitioner would submit that the festival is being conducted once in a year during the month of September. This year they have decided to conduct the festival from 04.09.2019 to 08.09.2019. Therefore, he has submitted a

representation to the third respondent on 12.08.2019 seeking permission to give adequate police protection for them to conduct festival from 04.09.2019 to 08.09.2019.

3. The learned Government Advocate(Crl.Side) would submit that the representation given by the petitioner is pending for consideration before the third respondent. He would submit that immersion of Vinayagar statue is fixed on 08.09.2019 in the same locality, therefore except 08.09.2019 the third respondent is ready to provide police protection .

4. By way of reply, the learned counsel for the petitioner would submit that instead of 08.09.2019, they are ready to conduct the festival on 09.09.2019.

5. It is also seen that this every year the petitioner has approached the respondent for similar direction to conduct the festival and this Court has also directed the respondents to consider the representation and ordered to provide police protection.

6. Taking into consideration the facts and circumstances of the case, third respondent is directed to consider the representation given by the petitioner and provide adequate police protection to the petitioner to conduct the festival in Annai Velankanni Gurusadi Festival of Sacred Heart Church, Irudhayakulam at Survey No.385/2 New Survey No.1370, Vikramasingapuram, Ambasamudram Tk. Tirunelveli District from 04.09.2019 to 07.09.2019 and 09.09.2019. If any untoward incident happens the third respondent is at liberty to take appropriate action against the concerned persons. 7.

With the above direction, this Writ Petition stands disposed of. No costs.
