Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondent to remove the encroachment made in Cart track at Survey No.605/3, Koothampoondi Village, Oddanchatram Taluk, Dindigul Dsitrict by considering the representation dated 13.08.2019 within a time frame that may be fixed by this Court.

[Order of the Court was made by T.S.SIVAGNANAM, J.] Heard Mr.S.C.Herold Singh, learned counsel appearing for the petitioner, Mr.M.Murugan, learned Government Advocate, appearing for the respondent.

2. By consent of both parties, this writ petition is taken up for final disposal.

3. The writ petition has been filed designing as Public Interest Litigation to remove the encroachment by considering the petitioner's representation dated 13.08.2019. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Government Advocate appearing for the respondents, on instructions, submitted that since objections were received from certain encroachers, the Tahsildar, Ottanchathiram Taluk has directed the Taluk Surveyor to conduct survey by proceedings dated 03.09.2019 and it is further submitted that after survey is conducted appropriate action will be taken for removal of encroachment.

5. The stand taken by the respondents is placed on record and this writ petition is dismissed. No costs.
